Terms of Service.
How we quote, what we need from you on site, and the basis on which we supply event production.
These terms cover the use of this website and the general basis on which Waveform Entertainment supplies event production services. The commercial detail for any particular event lives in the written quotation we issue for it.
About these terms
By using this website you accept the section headed "Using this website" below. The remaining sections describe how we work and apply once you accept a quotation from us. Where anything in these terms conflicts with a signed quotation or contract for a specific event, that document takes precedence.
Who we are
Waveform Entertainment supplies technical event production, sound, staging, LED screens, backline and event branding, from Tsavo, Ngong Road, Nairobi, Kenya. You can reach us on +254 182 168 709 or through our contact page.
Quotes and bookings
Submitting the booking form on this site is a request for a quotation. It is not a booking and it does not commit you to anything. We will come back to you with a written quotation setting out the equipment, crew, schedule and price for your event.
A booking exists once you have accepted that quotation in writing and met whatever deposit it specifies. Until then the date is not held and the equipment is not reserved, because both are allocated on a first-confirmed basis.
Quotations are valid for the period stated on them. Prices can change if the scope changes, if the event moves to a different venue or date, or if the guest numbers move materially away from what we quoted for.
Prices, payment and cancellation
The price, the payment schedule, the deposit and the cancellation terms for your event are set out in the quotation you accept, and it is that document that binds both of us. We put them in writing for every job precisely so that nobody is relying on a general web page for the commercial terms of a specific event.
Quoted prices cover what the quotation lists. Work added on site that was not quoted for, extended hours, additional equipment or a change of venue may be charged in addition, and we will tell you before incurring it wherever circumstances allow.
What we need from you
To deliver an event safely and on time we need certain things from you or your venue. These are the usual causes of a difficult build, so they are worth stating plainly:
- Access to the venue at the agreed load-in time, with a route in that suits the equipment.
- Adequate, stable mains power appropriate to the rig, and somewhere safe to run cable.
- Any permits, licences or venue permissions required for the event, including those relating to noise and to public entertainment.
- Accurate information about the venue, the schedule and the guest numbers.
- A safe working environment for our crew, and reasonable security for equipment left on site.
Where something on this list is missing and it delays or prevents the build, we are not responsible for the consequences, and any additional cost falls to you.
What you can expect from us
We will supply the equipment and crew described in the quotation, in working order and operated by people competent to run it. We will arrive in time to build and test before your event begins. If a specific item becomes unavailable, we will substitute equipment of an equivalent or better standard rather than quietly downgrade the rig.
Equipment
All equipment we bring remains our property throughout. You are responsible for it while it is on site and outside our direct supervision, and for loss or damage caused by you, your guests or your other suppliers, beyond fair wear and tear. Please do not allow anyone other than our crew to operate, move or reconfigure it.
Health, safety and the right to stop
Our crew follow safe working practice, and we ask that you support them in it. We may pause or stop work where continuing would be genuinely unsafe, for example in severe weather affecting an outdoor structure, where power is unsound, or where crowd conditions make it dangerous. We will always try to find a workable alternative first, and we will explain the decision.
Circumstances beyond control
Neither of us is liable for failing to perform because of something genuinely outside our control, such as severe weather, fire, flood, civil unrest, government restriction, or the failure of public infrastructure. If that happens we will work with you to reschedule or to find a practical alternative.
Liability
We are responsible for loss or damage caused by our own negligence or by our failure to do what we agreed to do. We are not responsible for indirect or consequential losses, such as lost profit, lost sponsorship or reputational loss. Except where the law does not permit it to be limited, our total liability in connection with an event is limited to the amount paid to us for that event. Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud.
Photography and credits
We photograph our own work, and we may use images of the production we built, the stage, the rig and the branded environment, in our portfolio and on our social channels. We will not publish images that identify your guests, and we will not name you as a client without your agreement. If you would prefer we did not photograph your event at all, tell us in advance and we will not.
Using this website
The text, photographs, layout and design of this website belong to Waveform Entertainment. You are welcome to read, share and link to it. Please do not copy it, republish it or use our name, logo or photographs to represent your own work.
We keep the site accurate and current, but it describes our services in general terms and it is not itself an offer. Nothing on it should be treated as a fixed price or as a technical specification for your event. That is what a quotation is for.
Handling of any personal information you submit through this site is covered by our Privacy Policy.
Governing law
These terms, and any agreement for event production services arising from them, are governed by the laws of Kenya, and the courts of Kenya have jurisdiction over any dispute. Before anyone reaches that point, we would much rather talk it through, so please contact us first.
Changes to these terms
We may update this page from time to time. The version that applies to your event is the one in force when you accepted your quotation.
